Seabreeze Rules and Regulations are managed by the Park Management. All questions, concerns or comments must be communicated with Park Management directly. The SRA and HOA do not have Park Rules and Regulations oversite.
SEABREEZE MOBILE ESTATES | RULES AND REGULATIONS
Pursuant to Florida Statute 723.035, the following are declared the Rules and Regulations for the operation of Seabreeze Mobile Estates. Rules 1 through 34 are common for both parks. Rules 35 and 37 are listed for each park.
1. AGE
In accordance with the Federal Fair Housing for Older Persons Act of 1995. This Park is intended to be reserved for residents age 55 and over with certain exceptions as allowed by the Act. All prospective residents will be screened for admission to the park under this Rule, and the home must be permanently occupied by at least one person who is 55 years of age or older as of the date of occupancy. No applications will be accepted without proof of age such as valid driver’s license, birth certificate or passport. Minimum age for all residents, except spouses and permanent full-time caregivers whose presence is required by a licensed physician, is 40, Under the Act, Management may, in its sole discretion, make certain exceptions to the rule.
2. COMMERCIAL ACTIVITY
The Park or its address will not be used for the purpose of advertisements or sale of autos, mobile homes, travel trailers, services, or merchandise without written consent of management. Only approved “For Sale” signs may be displayed on the mobile home or lot itself. New purchaser must be approved by the park management.
3. EVICTION
Any tenant may be evicted upon any of the following grounds, to-wit:
a. Nonpayment of rent
b. Conviction of a violation of some Federal, State, or local law when such violation is detrimental to health, safety, or welfare of other Park dwellers.
c. Violation of Park Rules and Regulations, pursuant chapter 723.04, Florida Statutes
d. Violation of terms of Tenant’s lease
e. Change in the use of Park land.
4. EXTERIOR IMPROVEMENTS | ADDITIONS | APPEARANCE
Exterior improvements or additions by the Tenant to his mobile home may be affected only with the written consent of the Park Office. Improvements and additions to the interior and exterior of Tenants mobile home must comply with all applicable building codes and laws.
a. Major appliances, as refrigerators, food freezers, washing machine or clothes dryer are not permitted to “free Stand” on driveways and must be enclosed in a utility room, approved screen room or in a location approved by the office.
b. Each Tenant shall keep his premises in a state of good repair and appearance compatible with other homes and premises so as not to detract from the symmetry and décor of the Park. Flower beds, planter boxes, special plantings, carport driveways and the entire outdoor area shall be kept neat, clean, and orderly by the tenant. Concrete driveways on residents lots may not be painted, stained or asphalt coated with park officers’ permission and approval of colors.
c. Fences will not be permitted
5. GARBAGE COLLECTION
All papers and garbage must be placed in proper containers, fastened shut securely, and placed at the street edge for pickup on Mondays and Thursdays. Garbage cans must be stored in utility buildings or garbage hides and plastic liners used at therein at all times. Branches and clippings must be tied securely in bundles not longer than 36” not more than 18” in diameter. Water heaters, old furniture and bedding shall be removed from Park at Tenant’s expenses.
6. GUESTS FEES
Rents are based on two or less adults per lot. No charge will be made for visitors staying less than fifteen (15) consecutive days or thirty (30) nonconsecutive days. Renting of room is not permitted.
7. GUEST HOUSE
No guest other than a member of the Tenant’s immediate family as herein defined may occupy a home in the absence of the Tenant provided the Tenant has first advised the Park owner the names of such persons and how long they are to so occupy the home, with a maximum being 2 weeks. For the purposes of this rule, Tenants’ immediate family shall consist of only Tenant’s father, mother, brother, sister, son, and daughter. Members of Tenant’s immediate family must comply with all other rules and regulations of the Park.
8. GUESTS OUTSIDE
Children under 18 years of age may visit Tenant’s premises as Tenant’s guest. However, no one child may visit any Tenant for more than thirty (30) days in any one calendar year. Children under eighteen (18) years of age are not permitted in the recreation hall unless accompanied by a parent or grandparent who shall be responsible for that child. The use of other recreational facilities by children under 18 will be governed by the rules of that facility.
9. HARRASSMENT
Harassment of owners, managers or employees will not be tolerated. Employees are instructed not to take directions from tenants. They are directed by written work orders only. Resident employees and manager are not to be approached for business discussion on the streets or in the recreation hall, especially during social events. All business shall be held at the office.
10. INJURIES
The landlord shall not be held responsible for injuries or damages caused by the operation of vehicles in the park by Tenants, members of their family or guests. Neither the Landlord nor any of the owners, managers, or representatives of ownership shall be liable or responsible for any injury or damage caused by fire, theft, accident, or other cause not due solely to the negligence of the Landlord.
11. SALE OR LEASING OF HOME
No home or lot shall be leased or subleased without the Park’s prior consent. No sale, transfer, assignment lease or sublease shall affect a transfer of tenancy without the Parks written consent and a sale or transfer of mobile home by a Tenant shall terminate the tenancy. Each home owner intending to sell a home within the park shall notify the park owner of the intention to sell the home, shall furnish the park owner the name, address and telephone number of the prospective purchaser and shall arrange or otherwise effect, before closing the sale, a visit by the purchaser to the park office during business hours on a work day in order that the park owner may decide whether to approve the prospective purchaser as a Tenant of the park and furnish the purchaser copies of park prospectus, Rules and Regulations as required by law.
12. LEGALITY
In the event any provisions herein promulgated by management is declared invalid, contrary to law public policy, or otherwise unenforceable, said provisions shall be deemed amended to comply with law or public policy. If compliance is impossible, said provisions shall be null and void. The remainder of this rental agreement, rules and regulations thereunder shall continue in full force and effect. Your lease is executed in Florida, 723.035. Florida Statues and other Florida laws, governing mobile home park tenancies and this lease is enforceable thereunder.
13. UNLAWFUL USE OF PREMISES
No immoral, offensive, or unlawful use of the premises will be allowed.
14. LIABILITY MANAGEMENT
The management or owners are not responsible for loss due to fire, theft or accident. Recreation facilities are at Tenants disposal and shall be used at their own risk. Landlord accepts no legal responsibility for Tenant’s safety except as already imposed by law.
15. MAIL
Mail will be delivered by the post office department to your mailbox in an area designated by the landlord. Maintenance of the mailbox is the responsibility of the tenant.
16. MAINTENANCE – HOMES
All maintenance of the Tenant’s mobile home shall be responsibility of the Tenant and the Park shall not be liable to anyone for any damage or injury caused by the tenant’s failure or negligence in the maintenance of his mobile home or leased premises. All tenants shall comply with all applicable laws, ordinances and regulations of the county, state, and this park. Each home shall bear a current license.
17. MAINTENANCE – LAWNS
Trimming around Tenants’ home is the sole responsibility of the tenant. Tenant shall notify the Park office of the name, address and phone number of the party maintaining the tenant’s lot during the tenant’s absence from the park. Unsightly or unreasonable kept yards shall be cleaned at the direction of the Park and the tenant assessed the reasonable cost of such service. No tenant shall burn any trash, leaves or similar waste material on the Park premises.
18. MAINTENANCE – UTILITIES
Any and all expenses of maintenance, repair or replacement of electrical service, lines or equipment from Tenants’ mobile home to Florida power and light meter shall be borne by tenant, except that any damage thereto caused by the acts of Park management through its officers or servants while engaged in Park business shall be chargeable to and borne by the Park owner rather than the tenant. All expenses of cleaning out sewer lines from the Tenants mobile home to and including the “clean-out” shall be borne by the Tenant.
Anyone hooking up plumbing facilities in their utility room must request and receive permission prior to installation and inspection thereafter.
19. NOISE
It is the purpose and intent of your Park management to guarantee freedom from disturbing noise and annoying acts of any kind always. Loud talking, the abnormal use of television or radio of any noise or act which may be disturbing to others must cease between the hours of 10:00PM and 7:00AM.
20. OFFICE HOURS
Management maintains office hours 9:00AM TO 3:00PM Monday through Friday at the park. Lunch from 12:00PM to 1:00PM from emergency calls only and after hours call 941-792-7798. Checks and notes about needed maintenance may be deposited in the mail slot at the office.
21.PARKING
No “on street” parking except for pick-up trucks, deliveries, installers or repairmen shall be allowed. Boats, boat trailers, travel trailers, van and motor homes may not be parked on the lot without prior approval of management. A storage area has been designated by the Park for such purposes. Recreational vehicles, trucks, campers, buses, motor homes, vans, pickup trucks, boats, and boat trailers are prohibited from parking at the recreation hall parking lot at any time. Please contact the office if additional parking is required for either overnight or for an extended period.
22. VEHICLES
Management specifically reserves the right to restrict the operation of all delivery transportation or other vehicular traffic within the Park which management deems to be detrimental to the interest of safety and traffic control, the well-being of the tenants and preservation of the Mobile Home Park grounds and roadways.
23. SPEED LIMIT
Speeds of fifteen (15) miles per hour will not be exceeded on the premises. Motor scooters and motorcycles are allowed in the park provided said vehicles are well muffled and not operated recklessly. Bicycle riding will be allowed, but bicycle riders shall obey all traffic regulations. No bicycles without lights will be allowed in park streets after sundown. All vehicles and motors must be operated with mufflers in good working order. Tenants shall be responsible for their guest’s observance of speed limit.
24. COMMERCIAL ACTIVITY
Recreational facilities are for the exclusive use of park residents or their house guests and are regarded as part of their home. Recreational facilities are open during hours specified by management, except during special events. The use of alcoholic beverages is not permitted in any of the recreational facilities except during special events and only then upon consent of management. Persons under 18 years of age shall not be permitted to use the recreational facilities unless under the supervision of one of their parents or one of their grandparents. Children under 18 are barred from the recreation hall during park functions unless invited by the Social Committee. Shirts and shoes must be worn in the recreation building at all times.
Cooperation in keeping recreation and other facilities clean and serviceable is requested and expected, since these facilities are regarded as part of your home. All equipment, machines or fixtures shall be left clean after use and should any item of equipment not be working properly, or repairs are needed, the matter shall be brought to management’s attention by a note delivered to the office. Men approaching in the recreational building or at the park office must wear some shirt other than just an undershirt. No bathing suits in recreation building or park office.
Clubhouse bulletin boards contain up to the minute news of activities and coming events.
25. SHUFFLEBOARD AND TENNIS
All posted rules must be observed.
26. RULES AND REGULATIONS
These rules and regulations may be amended from time to time by the Landlord. The Landlord agrees that such changes will not be made without notification to tenant at least ninety (90) days prior to implementation of any such changes. Such notice shall be affected by posting a copy thereof in the park recreation hall and mailed to all tenants.
27. SERVICES
The Landlord specifically retains the right, upon thirty (30) days written notice, to discontinue and deny all park services to any and all tenants, residents and occupants of the park who refuse to comply with these rule and regulations so as to fix policy and rules for situations not covered in these rules.
28. SIGNS
“For Sale by Owner” sign may be posted in mobile home
a. One sign per unit
b. Maximum size 10 x 14
c. One sign may be placed inside any window of home, so it receives maximum exposure to outside
29. SOLICITATION
Peddling, soliciting or other commercial enterprises shall be permitted in the park only with consent of the Landlord and each and all tenants shall report unauthorized presence of such persons.
30. TREES - SHRUBS
No tree may be planted without prior approval of the park, and when so planted shall become a permanent part of the land and may not be removed without the park’s written consent. The Tenant shall maintain all trees, plants and shrubs. Any prohibited planting may be removed without Tenant’s consent. The following trees and shrubs are prohibited: Jackaranda, Punk, paper bark, malalucuca, Leucadendron, cajeput, rubber tree family (including banyan, Cuban laurel, weeping laure) Australian pines, pepper trees, willow family trees and eucalyptus trees. Individual spaces shall be kept in an orderly fashion, neat, clean, and free of litter.
All plantings shall be spaced a minimum of 54” apart to provide access for mowing. Lawns, shrubs, and general landscaping remain under the direct control of management. (The terms, rock, stone, and gravel shall be considered interchangeable for the purposes of this document) Rock yards are prohibited effective August 15, 2001; this includes partial rock yards. After August 15, 2001, no additional rock yards will be permitted. A list shall be kept in the office of all rock yards installed prior to August 15, 2001. Rock yards installed prior to August 15, 2001, must be maintained, and kept in weed free state.
31. WILDLIFE AND FIREARMS
No firearms of any type are to be discharged within the park boundaries. Destruction, trapping, or harming wildlife in the park is prohibited unless authorized by park manager.
32. RENT
All rents are payable for the month in advance. Rents are due and payable on the first of each month and are considered delinquent on the tenth day of the month. After the 10th day a $25.00 late charge is added.
33. LAUNDRY
Laundry drying lines are to be located at rear of the home and are to be the umbrella type. No laundry on patios or carports. No laundry on Sundays or holidays.
34. PETS
No pets allowed on premises.
35. ZONING
Seabreeze Mobile Estates is zoned PDAP. The zoning authority is city of Bradenton. There are no definite future plans for changing the use of the land comprising the mobile home park or a portion thereof.
36. TELEVISION
TV antenna service is offered by the park. Indoor antennas will be permitted, but no outside antennas of any type may be erected.
37. SWIMMING POOL
Use of the swimming pool shall be governed by the pool regulations posted at the swimming pool. No one in swimming attire may enter the main recreation hall. Everyone using the pool or whirlpool must wear a pool identification tag. Children under 16 years of age are not allowed in the whirlpool. The swimming pool hours are posted on the pool building. ALL POSTED RULES MUST BE OBSERVED, not only for health and sanitation reasons, but also for the maintenance of the pools. Showering off suntan oil before entering the pool is a must.
